When is a misuse fee imposed?

The Federal Constitutional Court can impose a so called “misuse fee” in certain cases. This happens when the judges find the constitutional complaint undoubtedly inadmissible or unfounded.

The term “misuse” is partially inaccurate. The fee is not a sanction for a prohibited motion, but a special court fee as it is common before subordinate courts.
